TERMS OF USE

The Peak WiFi™ site Terms of Use (“Terms”) constitute a valid and binding agreement between Peak WiFi, LLC, with a mailing address of Post Office Box 1810, Pismo Beach, California 93448 (“Peak”) and the User (“User”) agreeing to these Terms.  User must agree to these Terms in order to access and use the Peak WiFi™ website ("Site").  Peak reserves the right to update the Terms of Use for this Agreement at any time without additional notice to Users.  The most current version of the Terms can be reviewed by clicking on the hypertext link located at the bottom of the homepage.   If you disagree with the Terms of Use, you may not use the Site. 

SECTION 1 - User Access:

In order to use the services provided on the Peak WiFi™ website, users must be given access via email from Peak.  User will be emailed a temporary password, and will then be prompted to reset their password and set a security question/answer before entering the Site.  Users are entirely responsible for maintaining the confidentiality of their password and security question answer.  Peak is not liable for any claims, losses, actions, damages, suits or proceedings relating to the sharing of your account and password with others or your failure to take appropriate security measures. 

SECTION 2 - User Information:

Use of our Site requires Users to give us contact information (like your address, phone number and email address).  We also collect limited financial information such as a credit card number.  The information is used solely to provide a means for online account payments. 

SECTION 3 - User Authentication:

User authentication is performed via password and security answer management by User.  Cookies may used to validate Users.  Cookies are deleted after logging out, closing the browser window, or timing out of the session. 

SECTION 4 - Description of Services:

Peak WiFi™ provides access to an Internet-based portal for Users to facilitate electronic payment services for monthly access fees, installation fees, equipment lease fees, and any other charges related to the use of Peak's wireless internet service.   You, as the User, are eligible to use the Services to pay your monthly access fees and any related fees.  Payments made through the Service will be remitted to Peak, and you will receive email notification of those payments. 

SECTION 5 - Privacy Notice:

Peak WiFi™ does not share or sell any of your information to anyone. 

SECTION 6 - Prohibited Use:

As a condition of your use of the Peak WiFi™ website, you will not use it for any purpose that is unlawful or prohibited by these terms, conditions, and notices.  You may not use the Site in any manner that could damage, disable, overburden, or impair our server, or interfere with any other User’s ability to use the Site.  You may not attempt to gain unauthorized access to any of the Site’s features, other accounts, or computer systems, through hacking, password mining or any other means.  You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Site. 

SECTION 7 - Termination of Access:

Users access to this service will terminate when they are no longer a current Customer at the resident address the account was established under, or when provider, at their discretion, disables online access for User. 

SECTION 8 - Relationship:

Peak and User understand and agree that this Agreement shall only govern the relationship between the two parties, and that no contractual relationship shall exist between Peak and any Peak WiFi™ website User. 

SECTION 9 - Forms of Payment:

Peak accepts various forms of payment including eChecks and credit cards such as MasterCard and Visa.

SECTION 10 - REFUND POLICY:

Services are required to be prepaid for each month, therefore, if user's account is current and a cancellation request is received by Peak WiFi™, then user will be entitled to receive service through the end of the current billing month and no refund will be issued. If user has prepaid for more than the current month of usage, those sums will be refunded if notice of cancellation is received prior to the beginning of those prepaid service periods. 

SECTION 11 - TRADEMARK:

Elements of Peak WiFi™ website are protected by trade dress, trademark, unfair competition, and other laws and may not be copied or imitated in whole or in part.  No logo, graphic, sound or image from the Site may be copied or retransmitted unless expressly permitted by Peak in writing.
